I stopped fire after he twisted away from me and fell.” However, a neighbor, Margaret Ginter, claimed that she witnessed Spencer yell an expletive at David before slowly driving away.

Margaret went on to say that Spencer came to a halt, got out, and pointed his rifle at David, who was approaching the vehicle from behind. “He (Spencer) came out of the truck, gun in hand, and killed Dave,” she testified. He just shot the guy dead in the head.” Others said David always had his hands up in the air, as if he was pointing, and never grabbed for anything in his pocket.
